In a crucial legal development, a federal court has temporarily stopped Elon Musk’s "Department of Government Efficiency" (DOGE) from accessing sensitive Social Security data. This decision marks a significant victory for union advocates concerned about privacy breaches.
The ruling emerged from a case filed by AFSCME, the American Federation of Teachers (AFT), and the Alliance for Retired Americans, represented by Democracy Forward. The court acknowledged that DOGE's access to personal data, including immigration, health, and financial records, violated privacy laws and posed significant risks.
AFSCME President Lee Saunders emphasized the importance of this decision, stating, “This decision sends a clear message to Elon Musk and his DOGE minions to keep their hands off Social Security." He criticized the actions of Musk's team for potentially harming vulnerable populations by disregarding legal protections.
The case attracted public attention as AFSCME members and retirees gathered outside the courthouse in Baltimore. Diana Lyles, from the Maryland AFSCME Retirees Chapter 1, voiced her concerns, saying, “We’re fighting to keep [Musk’s] hands off our Social Security. Elon Musk needs to mind his business and keep his nose out of our checks.”
The court's preliminary injunction restricts DOGE from accessing Social Security Administration data without fulfilling specific legal criteria, while the broader lawsuit continues. The plaintiffs argue that DOGE's actions breach the Privacy Act and other federal laws.
This decision follows a first-of-its-kind order mandating Musk's team to delete any personal data acquired. Despite these measures, concerns about privacy for those whose data was accessed remain high.
